Uganda Key Populations Consortium (UKPC) Statement on the Constitutional Court’s Ruling on the Anti-Homosexuality Act 2023

STATEMENT

On 03 April 2024, a significant legal development unfolded as the Constitutional Court of Uganda delivered its ruling on the consolidated constitutional petitions challenging the Anti-Homosexuality Act, a case in which our Director General, Richard Smith Lusimbo, played a pivotal role as one of the lead petitioners.

Court’s Ruling Overview

The Court’s ruling has brought forth several critical points of concern and reflection for our community:

  • Human Rights Framework: The Court acknowledged the global consensus that human rights are universal and inalienable, applicable to all individuals regardless of circumstances. However, it diverged significantly by stating that non-discrimination based on sexual orientation and related identities lacks legal support within the country’s statutory framework. This stance starkly contrasts with established international human rights principles and further marginalises the LGBTIQ+ community by codifying exclusion.
  • Health Considerations and HIV: The ruling highlighted perceived public health concerns, specifically associating HIV transmission risks with the LGBTIQ+ community’s practices. The Court’s reasoning, rooted in the perceived burden on the health system and economic implications, served as a basis for legitimising the Anti-Homosexuality Act. This perspective not only stigmatises but also undermines the collective efforts toward inclusive and effective public health strategies.
  • Equality and Non-Discrimination: Perhaps most alarmingly, the Court explicitly denied the existence of a Right to Equality and Freedom from Discrimination for the LGBTIQ+ community, asserting that without legal recognition, there can be no basis for claims of discrimination or inequality. This assertion dehumanises the community and equates their existence with criminal acts, exposing them to heightened vulnerability and societal harm.
  • Impact on Advocacy and Civil Society: The Court’s interpretation threatens to silence advocacy and support for the LGBTIQ+ community by framing such efforts as promotion and recruitment into homosexuality, thereby criminalising essential support services and human rights advocacy.

In the wake of this ruling, UKPC is undertaking a multifaceted strategy to address the implications of the Court’s decisions and ensure the continuation of our mission:

  2. Legal Recourse and Advocacy: UKPC together with partners, is exploring the possibility of appealing the decision in the Supreme Court, in close consultation with our legal team and partners. We remain committed to exhausting all legal avenues to challenge and overturn the detrimental aspects of this ruling.
  3. Operational Continuity and Risk Management: UKPC has proactively developed contingency plans to safeguard our operations, projects, and community engagements in light of potential legal and social challenges. We assure our community that our work and support services will continue, undeterred by the current adversities.
  4. Community Mobilisation and International Engagement: We will intensify our efforts to mobilise our community, engage with international human rights bodies, and leverage global solidarity to advocate for the rights and dignity of LGBTIQ+ individuals in Uganda and beyond.
  5. Public Awareness and Education: UKPC will amplify its public awareness campaigns to counter misinformation, educate the broader public on LGBTIQ+ issues, and foster a more inclusive and empathetic societal understanding.
